The above Parties are in agreement that the Terms and Conditions outlined below are to protect the Organiser and the Clients of the Congress THFF and both parties are in agreement that the terms and conditions set out below are to be adhered to. The following Terms of Condition are displayed for client viewing under French Law and all Clients who engage in Finacial Commitment to THFF will be in agreement of the Terms and Condition as set out below.

Mr Daniel John Bean and AES CANNES will not accept any form of negligence to any client who has failed to read and fully understand the terms and conditions set out below, and all queries must be forwarded to Mr Daniel Bean by email <daniel.bean@thehedgefund-forum.com> prior to any payments being forwarded to the Administration Company AES CANNES. Any receipt of payment made to AES CANNES  will automatically confirm that you fully understand and agree to the terms outlined below.

1. Mr Daniel John Bean the creator of THFF is responsible in a Directors Role and his capacity of Director will consist of the following.
a) Congress Planning.
b) Sales & Marketing
c) Client Liaison
d)  Client official Contact will include initial preparation, The actual Event, Closing of the Event, Cancellation and Refund Policies if required. 
e) Responsible for Client Contracts and Signatures.
f)  Responsible for forwading all Client documentation to AES CANNES by registered post.
g) Responsible for all Client enquiries in all areas of the Event ( exluding Invoicing queries)
h) Respondible for Website Development
i)  Respondible for Sales Revenue   j)  Responsible for Credit Control on delayed payments, AES Cannes will inform Mr Daniel John Bean of any payments that are not payed within the time frame stated on the Invoice.
k) Daniel John Bean is responsible for informing all clinets of the cancellation of Event Policy, Prior to any funds been forwarded to the administration Company

2. AES CANNES the Administration Company, role will consist of.

a) Manage all Contracts and Documentation received from Mr Daniel John Bean.
b) Issue the invoice to each client as per information received from Mr Daniel John Bean.
c) Responsible for the payment of invoices authorised by Mr Daniel Bean.
d) To hold all monies received by Clients on the registered Bank account of SARL AES CANNES.
e) To produce a detailed account of Profit and Loss after the Event issued to Mr Daniel John Bean
f)  To design the Refund and Cancellation Policy implemented on the website for client viewing ( this is in relation to French Law due to AES CANNES being registered under a French SARL Company.
g) To issue Invoice refunds under the terms and conditions outlined.

Both parties agree to fulfil there responsibilities

1. AES CANNES were appointed by Mr Daniel John Bean as the Administration Company for THFF Event.

2. The Event is to take place on the 23rd & 24th June 2008 in the Down Town Congress Centre New York

3. Mr Daniel John Bean will forward all Signed Contracts and Invoice details by registered post to AES CANNES on  receipt of a new Client .

4. AES CANNES will be responsible to forward the Invoice to the Client for payment within 30 days, by email.

5. All signed Contracts  will be kept by Mr Daniel John Bean and AES CANNES.

6. Mr Daniel John Bean ONLY reserves the right to cancel the Event. In this instance Mr Daniel John Bean will follow the the procedures set in place in points 1-8 listed below.

1. Will inform AES CANNES by registered post the full reason of Cancellation of the Event with a list of paid Clients.

2. Will inform each Client by registered post that the Event has been cancelled with full explanation, informing each client of the refund Policy, and inform the them which documents is required in order for the refund to be processed.

3. It is neccessary prior to the refund application being processed that the follwowing documentation must be forwarded in full to Daniel John Bean by registered post.
    
       a) Signed Contract with Mr Daniel John Bean with official Company Stamp, of AES CANNES
       b) Your registered letter of Cancellation received by Mr Daniel John Bean
       c) A copy of your payment remitance paid to AES CANNES
       d) A copy of your registered bank details with VAT registration number
       e) A completed refund request form which you will receive signed from Mr Daniel John Bean
   
4. On receipt of the above documents received from Mr Daniel John Bean AES CANNES will process the refund request and the documentation will be forwarded to the General Assurance registered in France as the official Company Insurance of AES CANNES. Any REFUND CLAIM may take from 4 Months - 8 Months from receipt of all Documents.

5. Please note that failure to forward all the relevant documents will result in an invalid claim and thus making it null an void.  All Documents will be forwarded to Mr Daniel John Bean with a detailed letter stating which documents hold the errors, and a new claim will may  be submitted under the same regulations as above.

6. AES CANNES will follow the above procedure in a professional and law abiding manner, and will endeavour to process your refund application in the minimum time scale possible

7. AES CANNES will act immeadietly to process the payment refund and a registered letter will be sent confirming receipt of documents and confirmation that your refund is been processed,  Failure to carry out the procedure AES may face legal action and all legal enquiries will be ackowledged by the legal Department of AES CANNES.

8. Mr Daniel John Bean who will complete all necessary tasks to ensure the Event will go ahead, will fulfil his position as outlined above. Failure to complete any of the procedures above will reflect in Legal ACTION taken by
AES CANNES and any other involved parties who are affected by Mr Daniel John Beans action's during the payment refund procedure.

Mr Daniel John Bean and AES CANNES have agreed to all Terms & Conditions and have agreed under French Law to post this information on the official website THFF.

For refund processing procedures must be directed to Mr Daniel John Bean at the above address, who will liaise with AES CANNES.

AES CANNES will be available to advise during the Payment refund procedure if necessary, and can be contacted at the Head Office during Monday - Friday 9.00am - 5.30pm.
